TWO FAIRMONT RESIDENTS FACE FELONY BURGLARY CHARGES. 26 YEAR OLD LOGAN JAMES MAHANKE FACES TWO COUNTS OF BURGLARY IN THE THIRD DEGREE AND 26 YEAR OLD AIRI SMITH FACES A 3RD DEGREE BURGLARY CHARGE. MAXIMUM PENALTIES ON EACH CHARGE IF CONVICTED ARE 5 YEARS JAIL TIME/10,000 DOLLAR FINE OR BOTH. BOTH ALSO ARE CHARGED WITH A COUNT OF THEFT WITH MAHANKE'S BEING A GROSS MISDEMEANOR WITH A MAX PENALTY OF 1 YEAR IN JAIL/3,000 DOLLAR FINE OR BOTH ; SMITH FACES A MISDEMEANOR THEFT CHARGE WITH A 90 DAY /1,000 DOLLAR FINE OR BOTH MAX PENALTY IF CONVICTED.

ACCORDING TO THE CRIMNAL COMPLAINT BOTH MAHANKE AND SMITH WERE SEEN ON VIDEO SURVEILLANCE AFTER ALLEGEDLY STEALING UP TO 648 DOLLARS FROM THE E Z WASH LAUNDROMAT IN FAIRMONT. VIDEO EVIDENCE PROMPTED LAW ENFORCEMENT TO OBTAIN A SEARCH WARRANT AT THEIR RESIDENCE. AS A RESULT OF THAT SEARCH AUTHORITIES RECOVERED CLOTHING ALLEGEDLY WORN BY THE SUSPECTS IN THE BURGLARY. UNDER QUESTIONING AIRI SMITH ALLEGED THAT SHE WAS WITH MAHANKE TO TAKE THE CHANGE BOX BACK ONLY AND NOT A PART OF THE BURGLARY ACCORDING TO THE POLICE REPORT.

DURING THE INITIAL SEARCH POLICE OBSERVED EVIDENCE OF DRUG USE AND OBTAINED ANOTHER SEARCH WARRANT FOR NARCOTICS AND FOUND METH PIPES AND BAGGIES CONTAINING A WHITE SUBSTANCE LATER TESTING POSITIVE FOR METH PLUS A DIGITAL SCALE. THAT NARCOTICS SEARCH LED TO BOTH FACING PETTY AND GROSS MISDEMEANOR CHARGES FOR POSSESSION OF METH AND PARAPHANALIA.
