FARIBAULT COUNTY DISTRICT JUDGE DOUGLAS RICHARDS HAS A DENIED A DEFENSE MOTION TO SUPPRESS EVIDENCE IN THWE MURDER CASE OF CEYLON MAN. 29 YEAR OLD BRIAN DANIEL FREEMAN IS FACING 11 FELONY COUNTS INCLUDING FIRST DEGREE MURDER IN THE DEATH OF 37 YEAR OLD CHRISTOPHER FULLMER OF BLUE EARTH LAST FEBRUARY.

DEFENSE ATTORNEY'S ARGUED THAT SOME EVIDENCE SHOULD BE THROWN OUT BECAUSE FREEMAN HAD NOT BEEN GIVEN HIS MIRANDA RIGHTS WHEN HE TALKED TO POLICE , TURNED OVER CLOTHING AND ALLOWED A SEARCH OF HIS VEHICLE. PROSECUTERS SAID FREEMAN HAD NOT BEEN PLACED UNDER ARREST SO OFFICERS WERE NOT REQUIRED TO MIRANDIZE HIM.

FREEMAN ALSO IS FACING CHARGES FOR INJURING HIS WIFE AND HER TWO TEENAGE DAUGHTERS WHEN HE ENTERED FULLMER'S RESIDENCE AND ATTACKED THEM WITH A HAMMER.

JUDGE RICHARDS RULED THAT FREEMAN'S STATEMENTS TO POLICE WERE VOLUNTARY AND DENIED THE MOTION TO SUPPRESS.

THE NEXT HEARING DATE FOR FREEMAN IS SET FOR NOV. 19.
