THE FAIRMONT BOARD OF ZONING APPEALS WAS BUSY TUESDAY NIGHT. ONE OF THEIR APPEALS WAS FROM SUSAN KRUEGER OF 192 W. BELLE VUE ROAD WHO CHALLENGED THE CITY FOR ALLOWING A NEIGHBOR - AL WOHLRABE OF 188 W. BELLE VUE ROAD - TO OBTAIN A PERMIT TO EXPAND A GARAGE ON HIS PROPERTY EVEN THOUGH THE SPECIFICATIONS FOR THE PROJECT DID NOT MEET LANGUAGE THAT WAS CURRENTLY IN CITY CODE BUT THAT HAD BEEN THE PRACTICE OF CITY CODE ENFORCEMENT FOR THE PAST SEVERAL YEARS.

MS. KRUEGER PRESENTED FOUR OBJECTIONS TO THE BOARD INCLUDING; SIDEYARD SETBACK, BUILDING HEIGHT, NONCONFORMING STRUCTURE AND SHORELAND OVERLAY DISTRICT GUIDELINES. SHE CHALLENGED THE BOARD BY ASKING "DOES THIS MEET CODE" AFTER EACH ONE.

FAIRMONT CITY ADMINISTRATOR MIKE HUMPAL SPOKE FOR THE CITY STAFF IN SAYING THE PROPERTY HAD BEEN GRANDFATHERED IN WHEN ANNEXED BY THE CITY SO MAKING SOME CHANGES IMMUNE FROM CODE DISCREPANCIES. HE ALSO ADDED THE NONCONFORMITY IS THE SIDE YARD SETBACK AND NOT THE STRUCTURE ITSELF AND THE BUILDING IS NOT SUBSTANDARD PER SHORELAND OVERLAY DISTRICT SPECIFICATIONS. THE CITY REMOVED THE HEIGHT ISSUE FROM THE CODE WITH AN UPDATE APPROVED AT MONDAY NIGHT'S SPECIAL CITY COUNCIL MEETING.

IN THE END THE BOARD OF ZONING APPEALS MEMBERS WERE HESITANT TO MAKE A DECISION WITH CONCERNS THAT THEY WERE JUST APPOINTEES AND HINTED THAT THE CITY STAFF AND ELECTED OFFICIALS MAYBE DIDN'T HANDLE THE SITUATION PROPERLY BEFORE FINALLY GETTING A MOTION AND A SECOND TO DENY THE APPEAL OF SUSAN KRUEGER AND ALLOW AL WOHLRABE'S CONSTRUCTION TO CONTINUE.

MIKE HUMPAL SAYS THE DECISION CAN BE APPEALED TO THE CITY COUNCIL.

THE FAIRMONT BOARD OF ZONING APPEALS TUESDAY APPROVED TWO REQUESTS FOR VARIANCES FROM BUILDING PERMITS.

SCOTT UNKE WAS SEEKING A VARIANCE TO ALLOW FOR THE SISSETON LAKESHORE PLANNED UNIT DEVELOPMENT TO BE BUILT WITH 4 RENTAL PROPERTIES IN THE AREA SOUTH OF THE EXISTING MARINA LODGE BETWEEN LAKE SISSETON AND LAKE AVENUE IN FAIRMONT. THE MINNESOTA D N R AGREES WITH THE VARIANCE REQUEST ACCORDING TO FAIRMONT CITY ADMINISTRATOR MIKE HUMPAL FOR A 6.8 FOOT SIDEYARD SETBACK AND UNIT DENSITY VARIANCE FOR THE 4 UNITS.

THE BOARD ALSO APPROVED A VARIANCE REQUEST FOR WILLIAM BLOMSTER OF 34 COTTAGE STREET FOR A LARGER GARAGE AT THAT LOCATION.
