THE FAIRMONT CITY COUNCIL WAS PRESENTED WITH A QUESTION OF ALLOWING A GARAGE ADDITION TO CONTINUE AT 188 BELLE VUE ROAD DESPITE A NEIGHBOR'S OBJECTION CITING A CITY CODE VIOLATION.

THE PROPERTY OWNER WAS GRANTED A BUILDING PERMIT FOR AN ADDITION TO HIS GARAGE AND HAD ALREADY POURED THE CONCRETE FOUNDATION WHEN THE OBJECTION CAME UP. THE OVERALL HEIGHT WOULD NOT EXCEED 18 FEET TO THE PEAK OR 15 FEET TO THE MID POINT OF THE GABLE, WHICH HAS BEEN AN ALLOWABLE PRACTICE APPROVED BY CITY BUILDING STAFF SINCE THE 1990'S. BUT CITY CODE STATES THAT THE LIMIT FOR HEIGHT IS 15 FEET FROM THE FLOOR TO ROOF PEAK.

CITY ADMINISTRATOR MIKE HUMPAL SAID "SOMEWHERE ALONG THE WAY THAT POLICY WAS CHANGED BUT THE CODE WASN'T REWRITTEN TO REFLECT CITY STAFF POLICY". HUMPAL HAD CHECKED OTHER COMMUNITIES AND FOUND THAT FAIRMONT WAS NOT ALONE IN ITS CODE NOT REJECTING LONG TIME BUILDING POLICIES. IN HIS OPINION HUMPAL SAID THAT THE HOMEOWNER SHOULD BE ALLOWED TO CONTINUE WITH CONSTRUCTION AND ON THE OTHER SIDE THE CITY CODE LANGUAGE SHOULD BE CHANGED SOONER THAN LATER.

COUNCILOR BRUCE PETERS WAS CONCERNED ABOUT ALLOWING THE CONSTRUCTION WITHOUT AN AGREEMENT FROM BOTH PARTIES AND COUNCILOR TOM HAWKINS POINTED OUT OTHER INSTANCES WHERE CODE IS NOT QUITE MATCHED UP WITH CURRENT POLICY AND AND SUGGESTED AN OVERHAUL OF THE EXISTING CODE.

MIKE HUMPAL SAID HE WOULD DISCUSS THE SITUATION FURTHER WITH THE PARTIES INVOLVED TO COME TO SOME FORM OF AGREEMENT.
